Notice of approved amendment
This amendment is shown on Western Australian Planning Commission Plans 1.7408/1, 1.7409/1, 1.7410, 1.7411, 1.7412 and 1.7413.
The purpose of the amendment is to reserve sites created and acquired for a public purpose. In this respect, the proposals focus on four main areas:
- reserving land required and acquired for the provision of necessary infrastructure, such as electricity substations, water supply pump stations and land required for high schools
- recognising artificial waterways constructed within the Peel region
- protecting environmental and landscape values within the Peel region
- recognising the inclusion of land in state forests.
Five of the 34 amendment proposals involve the transfer of small areas of land to the urban or rural zone. These proposals:
- correct minor anomalies in the Peel Region Scheme; or
- give effect to an outcome negotiated between the Western Australian Planning Commission and the relevant landowner.
Related Changes to Local Planning Schemes
Pursuant to section 126(1) of the Planning and Development Act 2005, the City of Mandurah Town Planning Scheme No. 3, Shire of Murray Town Planning Scheme No. 4 and Shire of Waroona Town Planning Scheme No. 7 are also amended to reflect the inclusion of land within the Regional Open Space, Public Purposes and Waterways reservations as delineated by this amendment.
Pursuant to section 126(3) of the Planning and Development Act 2005, the City of Mandurah Town Planning Scheme No. 3 and the Shire of Murray Town Planning Scheme No. 4 are also amended as follows:
- Land located in Halls Head and Coodanup that is being transferred to the Urban zone under this amendment to the Peel Region Scheme is included in the Residential zone in the City of Mandurah Town Planning Scheme No. 3
- Land located in South Yunderup that is being transferred to the Urban zone under this amendment to the Peel Region Scheme is included in the Canal Development zone in the Shire of Murray Town Planning Scheme No. 4
- Land located in Furnissdale that is being transferred to the Urban zone under this amendment to the Peel Region Scheme is included in the Residential zone in the Shire of Murray Town Planning Scheme No. 4
Giving statutory effect to these amendments
The amendments to the Peel Region Scheme, City of Mandurah Town Planning Scheme No. 3, Shire of Murray Town Planning Scheme No. 4 and the Shire of Waroona Town Planning Scheme No. 7 take effect from Friday 10 February 2017, this being the date of publication in the Government Gazette.
