An amendment to the MRS changes the zoning or reservation of land to allow for a different land use.

How long does an MRS amendment take?

In general, a major MRS amendment usually takes 24 months to complete, depending on the environmental assessment process, the number of submissions and requests for hearings. The Western Australian Planning Commission (WAPC) will consider all submissions before making a recommendation to the Minister for Planning.

 

MRS amendments for public comment

MRS Minor amendment 1346/57 - Lots 705 – 708 Armadale Road, Treeby

The Western Australian Planning Commission (WAPC) is seeking public comment on a proposal to amend the Metropolitan Region Scheme (MRS) for land in the local government area of Cockburn.

This amendment proposes to rezone approximately 47.68 hectares from Rural–Water Protection to Urban under the MRS; carry out a minor rationalisation of Bush Forever site 390; and reserve 0.52 hectares as Primary Regional Roads to enable the residential development of the subject land.

The WAPC certifies that, in its opinion, the proposed amendment does not constitute a substantial alteration to the MRS.

MRS Major amendment 1270/41 - Ocean Reef Marina Redevelopment

Public Submissions

MRS Major amendment 1270/41 seeks to rationalise various zones and reserves, and part of Bush Forever Site 325 to facilitate the redevelopment of the existing Ocean Reef Marina Boat Harbour.

The WAPC will consider all submissions (including hearings) before making a final recommendation to the Minister for Planning. The Amendment will then be presented to the Governor, and if approved, will be tabled in both houses of Parliament for a decision.

The MRS Amendment cannot be finalised until the Minister for the Environment has determined the separate Public Environmental Review.

Negotiated Planning Outcome

A draft Negotiated Planning Outcome (NPO) to secure an appropriate conservation outcome for Bush Forever Site 325 has been prepared by the City of Joondalup in consultation with the Department of Planning, Department of Parks and Wildlife and the Office of the Environmental Protection Authority.

The NPO is available for public comment through the City of Joondalup at the same time as the MRS amendment and Public Environmental Review. The NPO is required to be finalised prior to a final decision being made on the MRS amendment.

Public Environmental Review

The proposal to construct and operate the Ocean Reef Marina (marine-based components) is being assessed through a Public Environmental Review. The Environmental Protection Authority’s assessment of the marina proposal is required to be finalised prior to the WAPC making a final determination on the Amendment.

Submissions on the Public Environmental Review closed Friday 24 February 2017.

MRS Major amendment 1332/41 - Swan Valley Omnibus 1

Public comment on three proposals to amend the Metropolitan Region Scheme (MRS) for land in the City of Swan closed 5pm, Friday 22 June 2018.

  • Lot 33 Padbury Avenue, Millendon - to transfer 6.50 hectares and a portion of the Padbury Avenue road reserve from Parks and Recreation reservation to the Rural zone.
  •  Lot 102 Harrow Street, West Swan - to transfer 3.29 hectares from Public Purposes - Commonwealth Government reservation to the Rural zone.
  • Riverbank Detention Centre, Caversham - to transfer 0.19 hectares from Parks and Recreation to the Rural zone.

MRS Major amendment 1313/41 - Midland Freight Rail Realignment

The amendment seeks to transfer approximately 18 hectares from the Rural and Industrial zones and the Public Purpose and Parks and Recreation reservations to the Railways and Primary Regional Road reservations. The amendment will provide for the potential future realignment of the Midland freight rail line to improve amenity and accessibility with the Midland strategic metropolitan centre.

MRS Minor amendment 1328/57 - Hazelmere Enterprise Area Structure Plan – Precinct 7

The Western Australian Planning Commission (WAPC) sought public comment on a proposal to amend the Metropolitan Region Scheme (MRS) for land in the City of Swan.

The amendment proposes to rezone approximately 37.8 ha from the Rural zone to the Industrial zone in the MRS. The area includes a portion of the Stirling Crescent Road reserve and various properties bounded by Talbot Road to the south, Great Eastern Highway Bypass to the north and the Roe Highway to the east.

The Western Australian Planning Commission certifies that, in its opinion, the proposed amendment does not constitute a substantial alteration to the MRS.

Submissions closed 5pm, Monday 30 October 2017.

MRS Minor amendment 1339/57 - North-East and North-West Districts Omnibus 2

The Western Australian Planning Commission (WAPC) has sought public comment on a proposal to amend the Metropolitan Region Scheme (MRS) for land in the local government areas of Joondalup, Kalamunda, Mundaring, Swan and Wanneroo.

This amendment proposes to update various zones and reservations in the North-East and North-West Districts of the Perth metropolitan region at the request of Government agencies, servicing authorities and landowners, as outlined in the WAPC amendment report.

The WAPC certifies that, in its opinion, the proposed amendment does not constitute a substantial alteration to the MRS.

MRS amendments 1323/41, 1324/41, 1325/41 - Bullsbrook Urban Precinct

The Western Australian Planning Commission (WAPC) is seeking public comment on proposals to amend the Metropolitan Region Scheme (MRS) for the Bullsbrook Urban Precincts in the City of Swan.

The proposed amendments will facilitate further planning to enable the future development of the amendment area for urban residential purposes.

1323/41 – South Bullsbrook Urban Precinct

The purpose of this proposed amendment is to transfer approximately 210.7 ha of Rural zoned land to the Urban Deferred zone in the MRS.

1324/41 – Central Bullsbrook Urban Precinct

The purpose of this proposed amendment is to rezone approximately 153.17 ha of Rural zoned land to the Urban Deferred zone in the MRS.

1325/41 – North Bullsbrook Urban Precinct

The purpose of this proposed amendment is to rezone approximately 63.75 ha of Rural zoned land to the Urban Deferred zone in the MRS.

MRS Minor amendment 1343/57 - South East and South West Districts Omnibus 3

The Western Australian Planning Commission (WAPC) sought public comment on a proposal to amend the Metropolitan Region Scheme for land in the local governments of Armadale, Cockburn, Gosnells, Kwinana, Rockingham and Serpentine-Jarrahdale.

The amendment proposed to update various zones and reservations in the South East and South West districts of the Perth Metropolitan Region Scheme (MRS).

Proposals within the amendment include; small scale amendments to the region scheme, the rationalisation of zones and reservations to match cadastral boundaries, updates to reflect infrastructure or buildings as constructed, and other general updates to ensure the MRS is kept up-to-date as the statutory regional plan for Perth. The amendment contains 22 separate proposals.

MRS Minor amendment 1341/57 - Central Districts Omnibus 5

The Western Australian Planning Commission (WAPC) sought public comment on a proposal to amend the Metropolitan Region Scheme (MRS) for land in the local government areas of Bassendean, Belmont, Cambridge, Canning, Claremont, Melville, Mosman Park, Nedlands, Perth, South Perth, Stirling and Victoria Park.

This amendment proposes to update various zones and reservations in the North-East and North-West Districts of the Perth metropolitan region at the request of Government agencies, servicing authorities and landowners, as outlined in the WAPC amendment report.

The WAPC certifies that, in its opinion, the proposed amendment does not constitute a substantial alteration to the MRS.

MRS Major amendment 1138/41 - East Leighton

The purpose of this amendment is to transfer the lots, reserves and portions of reserves from parks and recreation to the urban zone.

MRS Major amendment 1199/41 - West Perth Regeneration Precinct

The purpose of this amendment is to rezone approximately 9.3 ha of land bounded by Loftus Street, Charles Street, Newcastle Street and the Mitchell / Graham Farmer Freeways from the industrial zone to the urban zone in the Metropolitan Region Scheme (MRS).

MRS Minor amendment 1340/57 - South Forrestdale Business Park Stage 2

The Western Australian Planning Commission (WAPC) sought public comment on a proposal to amend the Metropolitan Region Scheme (MRS) for land in the local government area of Armadale.

This amendment proposes to rezone approximately 153 hectares from the Rural zone to the Industrial zone in the MRS, as outlined in the WAPC amendment report.  The amendment will facilitate further planning to enable the future development of the amendment area for industrial and related purposes, the coordination of servicing and the interface of the industrial expansion area with the adjacent environmental values.

The WAPC certifies that, in its opinion, the proposed amendment does not constitute a substantial alteration to the MRS.

MRS amendments finalised

MRS Minor amendment 1342/57 - Eric Singleton Reserve And Environs

The Minister for Planning has approved, as advertised, the abovementioned amendment to the Metropolitan Region Scheme. The amendment is shown on Western Australian Planning Commission (WAPC) plan 3.2714 and is effective from the date of publication of this notice in the Government Gazette.

By virtue of section 126(1) of the Planning and Development Act 2005, the City of Bayswater local planning scheme is amended to give effect to the reservation included in MRS Amendment 1342/57.

MRS amendment 1349/27 - Lots 1793-1795 Matison Street, Southern River, City of Gosnells

Notice of Resolution – Clause 27

Notice is hereby given that in accordance with Clause 27 of the Metropolitan Region Scheme, the Western Australian Planning Commission (WAPC) resolved on 24 October 2018 to transfer approximately 10.3 ha, being parts of Lots 1793 and 1794, and the whole of Lot 1795 Matison Street, Southern River, from the Urban Deferred zone to the Urban zone, as shown on WAPC plan 4.1652.

Pursuant to section 126(3) of the Planning and Development Act 2005, the WAPC has the option of concurrently rezoning land that is being zoned Urban under the MRS, to a “Development” zone (or similar), in the corresponding Local Planning Scheme.

The WAPC agreed to the land being transferred from the General Rural zone and No zone to the Residential Development zone in the City of Gosnells Local Planning Scheme No. 6.  Accordingly, the amendment to the Metropolitan Region Scheme and the City of Gosnells Local Planning Scheme No. 6 is effective from the date of publication of this notice in the Government Gazette.

MRS Minor amendment 1331/57 - Rosehill Waters, City of Swan

The Western Australian Planning Commission (WAPC) has sought public comment on a proposal to amend the Metropolitan Region Scheme (MRS) for land in the local government of Swan.

The amendment proposes to rezone portions of Lots 200 and 9000 West Parade, South Guildford from the Rural to the Urban zone and to transfer a 1.3 hectare portion of Lot 200 West Parade, South Guildford from the Rural zone to the Parks and Recreation reservation to facilitate a land exchange with a 1.68 hectare portion of Lot 82 West Parade, South Guildford which is to be transferred to the Urban zone.

The WAPC certifies that, in its opinion, the proposed amendment does not constitute a substantial alteration to the MRS.

The Minister for Planning has approved, as advertised, the abovementioned amendment to the Metropolitan Region Scheme.  The amendment is shown on Western Australian Planning Commission (WAPC) plan 3.2693 and is effective from the date of publication of this notice in the Government Gazette.

By virtue of section 126(1) of the Planning and Development Act 2005, the City of Wanneroo local planning scheme is amended to give effect to the reservation(s) included in MRS Amendment 1322/57.

MRS Minor amendment 1329/57 - Henley Brook Urban Precinct

Notice of Approved Amendment

The Minister for Planning has approved, as advertised, the abovementioned amendment to the Metropolitan Region Scheme.  The amendment is shown on Western Australian Planning Commission (WAPC) plan number 3.2705 and is effective from the date of publication of this notice in the Government Gazette.

Pursuant to section 126(3) of the Planning and Development Act 2005, the WAPC has the option of concurrently rezoning land that is being zoned Urban under the MRS, to a “Development” zone (or similar), in the corresponding Local Planning Scheme.

The WAPC agreed to the land being zoned Urban within MRS amendment 1329/57 being transferred to the Residential Development zone in the City of Swan Local Planning Scheme No. 17.  This amendment to Local Planning Scheme No. 17 is effective from the date of publication of this notice in the Government Gazette.

MRS Major amendment 1210/41 - Rationalisation Of Stirling Highway Reservation

Outcome of Amendment

 It is hereby notified for public information that the Rationalisation of Stirling Highway Reservation amendment to the Metropolitan Region Scheme (MRS) has been submitted before both Houses of Parliament in accordance with the provisions of section 56 of the Planning and Development Act 2005.

This amendment, as depicted on Western Australian Planning Commission (WAPC) plan number 2.0801/2, is effective in the MRS on and from 30 January 2017.

By virtue of section 126(1) of the Planning and Development Act 2005, the City of Fremantle, City of Perth, Town of Claremont, Town of Cottesloe and Town of Mosman Park Local Planning Schemes are amended to give effect to the reservations included in MRS Amendment 1210/41.

MRS Major amendment 1280/41 - Mangles Bay Marina

Outcome Of Amendment

It is hereby notified for public information that the Western Australian Planning Commission (WAPC) has resolved that Metropolitan Region Scheme (MRS) amendment 1280/41 – Mangles Bay Marina not proceed to finalisation. The Minister for Planning has agreed with the resolution of the WAPC and, pursuant to Section 49 of the Planning and Development Act 2005, has withdrawn the amendment. The amendment process has therefore concluded with no change to the MRS.

MRS Major amendment 1291/41 - Herdsman Glendalough Precinct

Outcome of submissions

The Western Australian Planning Commission (WAPC) has considered all the submissions received in respect of the amendment proposal for Metropolitan Region Scheme amendment 1291/41 - Herdsman-Glendalough Precinct.  This proposal was first published in the Government Gazette on 15 December 2015.  The amendment is shown on WAPC plan number 3.2619/1.

The amendment, with modifications, has been presented to and approved by the Governor in accordance with the requirements of the Planning and Development Act 2005.  It will now be tabled in both Houses of Parliament, where it must remain for 12 sitting days.  During this time either House may, by resolution, disallow the amendment.  As soon as the amendment is no longer subject to disallowance it becomes legally effective in the Metropolitan Region Scheme.

The amendment, with modifications, has been presented to and approved by the Governor in accordance with the requirements of the Planning and Development Act 2005.  It will now be tabled in both Houses of Parliament, where it must remain for 12 sitting days.  During this time either House may, by resolution, disallow the amendment.  As soon as the amendment is no longer subject to disallowance it becomes legally effective in the Metropolitan Region Scheme.

It is hereby notified for public information that the Western Australian Planning Commission (WAPC) has resolved that Metropolitan Region Scheme (MRS) amendment 1310/41 - Guildford Road from East Parade to Tonkin Highway not proceed to finalisation.  The Minister for Planning has agreed with the resolution of the WAPC and, pursuant to Section 49 of the Planning and Development Act 2005, has withdrawn the amendment.
